Privacy Policy
two forty four a.m. LLC (“we,” “us,” or “our”) operates the Locale® mobile application (“App”) and twofortyfouram.com (“Website”). This privacy policy (“Privacy Policy”) describes how we collect, use, disclose, retain, and protect information through the App and Website. For purposes of applicable data protection law, two forty four a.m. LLC is the entity responsible for the information described in this Privacy Policy.
Although the remainder of this document is dedicated to the details of our privacy policy, highlights include:
- We will not spam you.
- The App does not require an account. All automation features work without signing in; an account is only needed if you choose to use backup and sync.
- We do not sell your information or use it for advertising.
- We do not transmit the contents of your address book or your calendar entries off of your device.
- Location-related history is stored in the App’s local database for on-device processing, not to build a cloud-based history of the places you visit.
- We collect the minimum amount of information necessary to provide and improve the App and related services.
- We use commercially reasonable efforts to protect your information and keep it secure.
- We perform on-device processing wherever possible.
1. We Collect And Use Certain Information
We collect information relating to you and your use of the App and Website in order to provide services and features that are easy to use and responsive to your needs. We use the term “Consumer Information” as an umbrella term for personal, pseudonymous, aggregate, and other information relating to you or your use of the App or Website. The following sections describe the categories of Consumer Information and the circumstances under which each category is collected.
1.1 Contact Information
Contact Information is information that allows someone to identify or contact you, including, for example, your name or email address. We do not intentionally collect Contact Information except when you contact us or choose to sign in to the App. Signing in is optional and is used only to enable backup and sync; all of the App’s automation features are available without an account. If you do not contact us or sign in, we do not associate your Situation Information with Contact Information.
In the event that you contact us, any information that you provide is used for the purpose of responding to your inquiry. When contacting us through the App’s “Priority Support” feature, some information about the device and App’s configuration will be included for the purpose of more quickly responding to your inquiry. You will have the opportunity to review and edit this information before it is sent.
We retain communications relating to customer support for reference purposes. For example, we can follow up with you when a bug you reported is fixed or a new feature you requested is added. We can also refer to previous messages you have sent us, in order to better understand your inquiry and previous troubleshooting steps we may have tried.
We may perform statistical analysis on inquiries in the aggregate, for example to understand which types of issues occur most frequently. We may also use automated or artificial intelligence tools to analyze historical inquiries in order to improve and develop support systems. Any service provider used for this purpose may process support information only on our behalf and for the tasks we direct it to perform.
1.2 Usage Information
Usage Information is information such as how many people are using the App per day, in what countries and languages the App is being used, on what devices and OS versions the App is being used, whether any errors occur, and what features are most popular.
We use Google Analytics through Firebase to collect Usage Information. Advertising identifiers are not collected. For more information, see how Google processes information from apps that use its services.
We use this information to prioritize which features to add to the App, decide which languages to translate the App into, identify bugs to fix, customize the user experience, and find other ways to improve the App. We also use this information to improve compatibility, fix bugs, update plug-ins, and improve features. This information is also used to deliver configuration updates to tune the App’s functionality.
Usage Information also includes security and integrity information about the environment under which the App is running, in order to ensure the App is performing as expected.
Usage Information also includes anonymous information about your device hardware and software that is automatically collected when you access the Website. This information is used for the purpose of operating the Website, maintaining the quality of the Website, and providing general statistics regarding use of the Website.
We do not associate Usage Information with Contact Information unless you sign in to the App. If you are signed in, we may contact you if we notice crashes or errors occurring for the purpose of proactively helping resolve the error.
1.3 Location Information
The App stores location-related history in its local database for on-device processing. This history is not routinely transmitted to us, but it may be included in Diagnostic Information that you choose to send for support. After you configure a Location condition and grant the necessary permissions, the App processes location signals on your device to determine whether the condition is met. These signals may come from Bluetooth devices, Wi-Fi access points, cell towers, navigation satellites, an IP address used to estimate location, and other reference points. They may include an access point’s MAC address, which is an alphanumeric code unique to that hardware device, or a cell tower’s cell ID.
You may also choose to calibrate a saved location to improve accuracy. If you are not signed in, the Location condition and its configuration remain only on your device. If you choose to sign in and use backup and sync, the saved configuration needed to restore your Location condition is backed up as part of your Situation Information. This backup preserves the automation you configured; it does not include the location-related history stored locally by the App.
1.4 Situation Information
Situation Information is user-configured information such as conditions to detect and settings for the App to apply automatically. You can use all of the App’s automation features without an account, in which case Situation Information remains only on your device. If you choose to sign in, Situation Information is backed up securely on our servers so that it can be synchronized and restored through your account.
1.5 Diagnostic Information
Diagnostic Information is a combination of Situation Information and historical information of the App’s background activity.
In the process of providing customer support, we may ask for Diagnostic Information so that we can troubleshoot. Diagnostic Information is not uploaded automatically or required to use the App; it is provided only when you choose to send it from within the App.
Diagnostic Information is uploaded over an encrypted connection and then encrypted at rest. We only retain Diagnostic Information for the duration of resolving your support inquiry, usually a few days. Afterwards the information is immediately deleted.
Diagnostic Information may contain raw sensor readings, internal status codes, activation history of situations, Situation Information, and location information used or recorded by the App for local processing. Diagnostic Information does not contain your calendar entries or address book.
1.6 Purchase Information
Google Play processes payments and maintains the underlying transaction records under Google’s Privacy Policy. We do not receive your payment card or bank account information.
Purchase Information is limited information that the App receives from Google Play, such as the product purchased, purchase time, order ID, purchase token, and subscription status. We use Purchase Information to verify purchases, provide paid features, prevent fraud, and troubleshoot billing. If you are signed in to the App, Purchase Information is associated with your Contact Information and stored with your Locale account. We delete this copy when you delete your account.
If we notice an error with your subscription or you cancel your subscription, we may send you a one-time correspondence for the purpose of resolving the error or understanding if there is anything we can do to improve the App.
2. How We Use Consumer Information
We use Consumer Information to provide, maintain, secure, support, and improve the App and Website; provide optional account backup and sync; manage subscriptions; respond to inquiries; and perform the other specific purposes described in Section 1. We may also use aggregate or deidentified information to understand how people use the App and Website. We do not sell Consumer Information or use it for advertising.
3. Disclosure of Consumer Information to Third Parties
We do not disclose Consumer Information to third parties for their own advertising or independent marketing purposes. We disclose Consumer Information only as described below, at your direction, or with your consent. We may also disclose aggregate or deidentified information that cannot reasonably be associated with an individual.
3.1 Contractors and Third-Party Service Providers
We use service providers and third-party platforms to perform or support specific functions. Some process Consumer Information on our behalf, while others process information under their own policies. Depending on the feature you use, these providers and platforms may include:
- Account, cloud hosting, and storage providers that process Contact Information and Situation Information to provide optional backup and sync
- Crash-reporting and diagnostic providers that process Usage Information and Diagnostic Information to help us identify errors, improve reliability, and resolve support inquiries
- Customer-support, email, and artificial intelligence analysis providers that process Contact Information, inquiry contents, and support history so that we can respond to inquiries and improve our support systems
- Google Play, which processes payments and maintains transaction records under its own policies and provides us with limited Purchase Information to manage purchases and subscription status
- Professional advisers, including attorneys, accountants, auditors, programmers, and consultants, that receive limited Consumer Information when necessary to provide their services
For providers that process Consumer Information on our behalf, we limit access to the information needed for their specific tasks and require them to protect its confidentiality and use it only as necessary to perform the services we direct them to perform. They may not sell Consumer Information or use it for their own advertising.
3.2 Compliance with the Law; Protection of our App
We may disclose Consumer Information when we reasonably believe disclosure is necessary to comply with a valid legal demand, subpoena, court or regulatory order, or other legal obligation; enforce our applicable License Agreement or other policies; exercise our legal rights or defend against legal claims; protect the integrity and security of our operations; protect our customers; or prevent a crime. We may also disclose Consumer Information in connection with a proposed or completed merger, acquisition, financing, reorganization, sale of assets, or similar business transaction, subject to appropriate confidentiality protections and notice if the transaction materially changes the practices described in this Privacy Policy.
4. Your Choices Regarding Consumer Information
For Locale X:
In order to function properly, the App requests access to certain types of information. For example:
- The Location condition requests permission to access location and monitor physical activity, so that it can detect places important to you and adjust settings automatically
- The Calendar condition requests permission to read the calendar, so that it can see scheduled meetings and adjust settings accordingly
Information obtained from the calendar or from current location signals is processed on the device, only after you configure the corresponding condition and explicitly grant permission. The condition configuration you create may be included in optional backup and sync or in Diagnostic Information that you choose to provide, as described in Section 1. If you do not wish the App to access this information, do not configure a Calendar or Location condition.
The App also requests permission to modify settings, configure do not disturb, send SMS messages, and perform other actions on your behalf. This access is used only after you configure the corresponding setting and explicitly grant access. Such permissions are used only to perform the specific actions you configured. The setting configuration you create may be included in optional backup and sync or in Diagnostic Information that you choose to provide, as described in Section 1.
For example, SMS permissions will only be requested when you configure the App to send an SMS. If you do not wish the App to access this, do not configure a Send SMS setting.
For versions of the App prior to Locale X:
In order to function properly, the App requests access to the calendar, contacts, “me” profile, and phone call state of the device. This information is used only within the App; it is not transmitted to or stored by us. For example, the Location condition uses the “me” profile and contacts to show locations important to the user like “home” and “work,” the Caller condition accesses contacts and phone call state to detect VIP callers, and the Calendar condition can see scheduled meetings and adjust settings appropriately.
This information is only used within the App and only after the user configures a Calendar, Location, or Caller condition. If you do not wish the App to access this information, do not configure a Calendar, Location, or Caller condition.
5. Security of Consumer Information
Because your privacy is very important to us, we have put in place commercially reasonable technical, physical, and administrative measures to protect the Consumer Information that we collect. Except as provided elsewhere in this Privacy Policy, we limit access to Consumer Information databases to our personnel who have a business need for such access, including servicing your account or aggregating Contact Information or anonymous Usage Information.
We use industry-standard security methods, such as strong encryption, one-way hash functions, multi-factor authentication, rotating passwords, physical and technical access controls, code and security reviews, and other measures, to secure the communication and storage of information throughout the App and Website. Despite these efforts, you should know that no one, including our company, can guarantee that such methods are 100% secure.
6. Information from Children
If you are under the age of 16, you should use the App only with the involvement of a parent or guardian and should not submit any personal information to us. We do not intentionally target children under 16. We comply with all applicable laws designed to protect children’s information. Children under the age of 16 should not use our App without obtaining prior parental consent.
7. General
7.1 Amendments to this Privacy Policy
We may occasionally update this Privacy Policy. When we do, we will add an entry to the Updates section at the end of this Privacy Policy and trigger a prompt in-app when the update is pertinent to you. Your continued use of the App constitutes your agreement to this Privacy Policy and any updates.
7.2 Technical Problems
Even though we have taken significant steps to ensure that your Consumer Information is never collected, used, or disclosed by us except as set forth by this Privacy Policy, technical mistakes are possible. If such a mistake takes place, we will take commercially reasonable steps to correct it.
7.3 Contact Us

7.4 Accessing, Correcting, and Deleting Your Information
You can access and correct your Situation Information directly in the App by viewing or editing your situations. We cannot access or edit Situation Information that remains only on your device. If you are signed in, changes you make in the App are synchronized through your account.
If you ask us to delete your previous support inquiries, we will delete the deletion inquiry and your prior inquiries. Deleting prior inquiries may cause future messages from the same email address to be treated as spam by our email system.
For Locale X:
- If you’d like to reset Locale’s anonymous usage data, please do so from within the App under the … menu in the About screen.
- If you’ve signed in to the App to back up and sync your situations and would like to delete your account and associated data, please open the Account screen, look under the … menu in the corner of the screen, and choose “Delete account.”
Deleting your account immediately and permanently deletes your Situation Information, Usage Information, and the Purchase Information that we store with your Locale account. It does not cancel an active Google Play subscription or delete transaction records independently maintained by Google Play. To cancel a subscription, manage it through Google Play.
For versions of the App prior to Locale X:
If you’d like to reset Locale’s anonymous usage data, please do so from the Privacy screen under the … menu on the App’s main screen.
7.5 Interpreting this Privacy Policy
Examples listed in this Privacy Policy are provided to assist your understanding of this Privacy Policy and are not intended as exhaustive lists. Section headings are provided for your convenience. This Privacy Policy supplements and is incorporated into the License Agreement.
